| I have tenants that have been continually late on paying rent. I have served three day notices numerous times in the past and that ususally works. Now I just want them out. Thier lease ended last December and I did not renew. I told them that since they still have not paid for July due on the 5th and it is the 12th, I want them out by the end of the month. | I sent the notice to claim on security deposit for damages 2 weeks after tenant vacated. Tenant replied within the 15 days saying that they disagree and will see me in court. Florida Statutes explains both parties should try to work a deal before going to court and if any of the parts file a law suite the prevailing part receives attorney fees..., but it seems that is no deal between parties. What action should I as Landlord take now? 1-Just wait to receive a court notice?
2-Should I send the remaining monies after deducted damages to the tenant as it state on my notice?(within a certain period?)

| In our lease it states that the tenant is responseible for the maintenance and repair of appliances and plubming if it was cause by the tenant. Our landlord is refusing to reimburse us 515.00 for a plumber that we called out since we thought we clogged the toliet ourselves when in fact our septic tank was filled to capacity. Are we entitled to have that reimbursed since it was not caused by us the tenants? If so is there a specific statute that we can cite and if there is a statute should we take the 515.00 out of our next rent payment (this would be that last before our lease is up).

cifelli-santos@comcast.net | --NEXT RESPONSE--I think you have a case, but unfortunately I think you are either going to have to negotiate with your landlord or file a civil small claims case to get your money back. I am not a lawyer so seek your own counsel. However, I do have the Landlord and Tenant Rights book. I looked this up and it says: There are no self-help tenant remedies available in Florida other than cancelling the rental agreement. Another entry says: Contrary to common belief, there is no right in Florida for a tenant to withhold rent as a means of enforcing tenant rights. So, I would say your best approach will be to just work this out with your landlord, end your lease gracefully and if you cant work it out file a small claims case. NOTE: I am not an attorney so this is not legal advice, just my thoughts on your question... |

I don't want to scare them off, but I should prepare them. | --NEXT RESPONSE--My policy on this is that I try to lock in whether a tenant will be renewing a lease or moving out approximately 3 months prior to their current lease expiring. Until then we are not discussing anything related to future leases. So to answer your question, my answer is no. I would not be talking about possible future increases in rent until about 3 months prior to their current lease expiring for the main reason that I do not know what the market conditions may allow in a year or what changes may occur during the year to warrant an increase. If you initiate this communication three months prior to their current lease expiring this is adequate time for them to decide if they want to move or possibly counter the offer. On another note, if your signing a lease and already thinking about how much you will increase the rent, perhaps you are not getting current market rate rent in which case you may want to re-think the current lease rate. I called the phone number on the form and the folks that answered knew about the tax but had no clue what it was for either. At first I thought maybe it was to perform inspections but they said it was not. The only thing I can think of is that it is a way for the city to make more money?--NEXT RESPONSE--The previous reply is correct, The annual fire assessment fee, if thats what your referring to has nothing to do with the Fire Dept. it's an additional unknown fee the city collects. I have argued this issue before and all I got from the city was smoke and mirrors. |

| How do you get the property value down? for tax purposes . . . | --NEXT RESPONSE--One easy method I have done and you may try yourself is simply calling broward county property appraisors office and talking to them. In the past this has worked for me. If your taxes are way outragous then there are other more complicated ways of doing it where you have to file a complaint and appear at a hearing (I have never done that process so I cant talk expertly on it.) The property appraisors office web site is www.bcpa.net. It should have information there about this topic as well. I also know if you use a property management firm they sometimes will handle this for you. |
